Status update on invitation of Tenders and Award of Contracts
as on 23.08.2023

The new management of Unitech Group has been receiving large number of queries over e-mails and telephones from the anxious home-buyers to know about the status of Invitation of Tenders and Award of Contracts in respect of their projects. This note on the status update is being published for their kind information.

Part - 1

  1. Pursuant to Hon’ble Supreme Court order dated 28.10.2021, 05 nos. of Project Management Consultants (PMCs) were appointed by the Management in December 2021, to undertake “As-is-Assessment” of various projects, preparation of “Bills of Quantities” (BOQs) for the balance works at individual project sites and preparation of tender documents for award of contracts for completion of projects. Simultaneously, Engineers India Limited (EIL) was appointed as a Third Party Inspection and Monitoring Agency (TPIA) to review the work of PMCs in the month of March, 2022. Further, the Hon’ble Supreme Court appointed Justice (Retd.) A. M. Sapre vide its order dated 18.05.2022 to be associated with every stage of tendering process and to be carried out under his supervision.
  2. Based on the ground-work done by PMCs, it was estimated that about 130 Tenders would be required to be floated for completion of all the 74 residential and 12 commercial projects. Since, it was practically not possible to float all 130 tenders in one go, the Management decided to float these 130 odd tenders in four to five lots with each lot comprising about 30-35 tenders, as also approved by the Hon’ble Supreme Court.
  3. Accordingly, after preparation of tenders of Lot-1 by PMCs, their review by the EIL, approval of the Board of Directors (BoD) and Justice (Retd.) A. M. Sapre in the month of November/ December 2022, a total of 35 Tenders were floated on 02.01.2023 on Unitech’s e-tendering web portal etenders.unitechgroup.com. After the last date of submission of tenders (20.02.2023), it was discovered that no bids were received against 18 tenders (out of 35) whereas both the bids received in case of one tender failed to meet the eligibility criteria and both the bids received in respect of another tender were abnormally high, resulting in the rejection of bids for these 02 tenders. Thus bids were required to be called afresh in respect of these 20 tenders (18+1+1).
  4. Balance 15 tenders, which were found to be technically eligible and financially acceptable, were recommended for Awards of Contracts by the PMCs and EIL, which in turn was duly approved by the BoD around 13th of April, 2023 and submitted to Justice (Retd.) A.M. Sapre for his approval and onward recommendation to the Hon’ble Supreme Court seeking permission for Award of Contracts to successful bidders qua these 15 tenders. Justice (Retd.) A. M. Sapre scrutinized the same and submitted his recommendations dated 24.04.2023 and 09.05.2023 to the Hon’ble Supreme Court.
  5. The list of these 15 Tenders, along with the scope of work covered under these tenders, is at Annexure-A.

Part - 2

  1. In continuation of the Tendering process, 2nd Lot of 31 Tenders were prepared by the PMCs and duly reviewed by the EIL. Thus a total of 51 Tenders (20 re-tenders of Lot-1 and 31 tenders of Lot-2) were approved by BoD and Justice (Retd.) A. M. Sapre in the month of April 2023 for uploading on Unitech’s etendering web portal. Accordingly, these tenders were uploaded on the portal on 08/09.05.2023.
  2. The extended last date for submission of bids in respect of these 51 Tenders was 22.06.2023. The Technical bids were opened on 23.06.2023 when it was discovered that no bids had been received in respect of 09 tenders. After completion of the process of evaluation of Technical and Financial bids, the management finalised the bids received qua 34 tenders. This has been approved by the Board of Directors followed by Justice (Retd.) A.M. Sapre on 18.08.2023. The recommendations of the Board and Justice Sapre have been made available to the Advocate on Record for placing the same before the Hon’ble Supreme Court on the next date of hearing of the Unitech matter.
  3. The list of these 34 Tenders, along with the scope of work covered under these tenders, is at Annexure-B.
  4. The Letters of Intent (LoIs) for Award of Contracts in these 15+34 Tenders would be issued to the Contractors after approval of the Hon’ble Supreme Court is received and works would commence at the respective projects thereafter. Assuming that the management receives the approval of the Hon’ble Supreme Court for award of contracts in respect of these 49 tenders by or before end of September 2023, the Homebuyers of these projects are advised to be ready for payment of the 1st Installment of their outstanding dues with effect from 01.11.2023.
  5. The work on preparation of Tender Documents proposed to be floated as part of Lot-3 is already in hand and expected to be completed, along with review by the EIL, by middle of September, 2023.
  6. All the home-buyers are requested to kindly visit the company’s website www.unitechgroup.com for regular updates on the tendering and award of contracts.

Sector 117, Noida

Status of different phases and the Plan for inviting Tenders
(As on 04.09.2023)

The management of Unitech Group has been receiving large number of e-mails from the aggrieved Home-buyers of Sector-117, Noida projects, to know about the status of Invitation of Tenders and Award of Contracts in respect of their projects. While it becomes difficult to respond to each mail individually, it has been considered advisable to upload a note on the same for kind information of all the Homebuyers. Hence this status note which gives the status update in this behalf.

  1. 1. The erstwhile management of Unitech had planned development of Sector 117 in six phases (plus the balance land for future development) wherein a total of 3286 residential Units have been sold to the Homebuyers (after taking into account refunds in 41 cases on grounds of Medical Exigencies and others on the directions of Hon’ble Supreme Court). The present physical status of the Projects across these phases is given below:

  3. It has been observed that the erstwhile management applied for Fire NOC and Occupation Certificate (OC) in respect of a total of 19 Towers of Phase-1 (13 Towers) and Phase-2 (06 Towers). The then management simultaneously offered possession of 1176 residential units in 15 towers (11 towers in Unihomes-1 and 04 towers in Unihomes-2) wherein 711 families took possession of their homes and currently, about 620 families are residing in the complex with incomplete infrastructure and lack of basic facilities like electricity, water and sanitation which are being provided on temporary basis for the last few years.
  4. Pursuant to Hon’ble Supreme Court order dated 28.10.2021, 05 nos. of Project Management Consultants (PMCs) were appointed by the Management in December 2021, to undertake “As-is-Assessment” of various projects, preparation of “Bills of Quantities” (BOQs) for the balance works at individual project sites and preparation of tender documents for award of contracts for completion of projects. Accordingly, M/s Sangam Project Consultants, was allocated the Sector-117 Noida projects. Simultaneously, Engineers India Limited (EIL) was appointed in the month of March, 2022 as a Third Party Inspection and Monitoring Agency (TPIA) to review the work of PMCs. Further, the Hon’ble Supreme Court appointed Justice (Retd.) A. M. Sapre vide its order dated 18.05.2022 to be associated with every stage of tendering process and to be carried out under his supervision.
  5. Based on the ground-work done by the said PMC, it was estimated that about 14 Tenders would be required to be floated for completion of all Sector-117 Noida projects. Since it was not possible to float all the tenders in one go, the Management decided to float these 14 tenders in phases/ Lots along with Tenders for other Unitech projects.
  6. Accordingly, after preparation of 01 tender by the PMC as part of Lot-1, its thorough review by EIL, approval of the Board of Directors (BoD) and Justice (Retd.) A. M. Sapre in the month of December 2022, the same was floated on 02.01.2023 on Unitech’s e-tendering web portal etenders.unitechgroup.com. After the last date of submission of tenders of Lot-1 (20.02.2023), the received bids were opened for technical evaluation. Subsequently, after the technical evaluation of the bidders, the financial bid was opened on 29.03.2023 wherein it was found that the quoted price by the single bidder was marginally higher than the justified cost. The L-1 bidder was called for negotiation on 06.04.2023 and was successfully persuaded to revise its bid to be within justified cost by the Negotiation committee. The successful bid was recommended for award of contract by the Board of Directors and followed by approval from Justice (Retd.) A.M. Sapre in the month of April 2023. Subsequently, the award of contract to the successful bidder was submitted to Hon’ble Supreme Court for seeking its approval, which is yet to be received.
  7. Similarly, two more tenders pertaining to the completion of Civil and Internal MEP works for all six phases of Sector-117, Noida projects were floated as part of Lot-2 Tenders on 08.05.2023 on Unitech’s e-tendering web portal. After the last date of submission of tenders (22.06.2023), it was discovered that no bids were received against one tender pertaining to Phase-4, Phase-5 & Phase-6, whereas one single bid was received against the tender pertaining to Phase-1, Phase-2 and Phase-3. After the technical evaluation, vetting thereof by EIL and opening of financial bid on 26.07.2023, it was found that the lone financial bid was unacceptably high. Thus bids are required to be invited afresh in respect of these 02 tenders splitting the same in to 05 Tenders. Now, the Tenders have been re-cast and it is proposed to invite 08 Tenders pertaining to Sector-117, Noida projects as part of Lot-3 Tenders which is likely to be floated by mid-September 2023.

The list of 220 eligible Homebuyers whose refunds have been approved by the Hon’ble Supreme Court on grounds of Medical Exigencies vide its order dated 13.10.2022 (Annexure 12 of Justice A M Sapre report ) is hereby uploaded on the Unitech Portal Under Refund Claims on Medical Grounds tab.

The procedure to be followed by the concerned Homebuyers for seeking refund is mentioned in the Notice placed on the same tab.

Notice to Fixed Deposit Holders

Refunds to FD Holders on grounds of medical exigency, as approved by the Hon’ble Supreme Court vide its Order dated 01.02.2023 on the recommendations of Justice (Retd.) A.M. Sapre

It is hereby notified for the information of all such FD Holders to whom the refunds have been approved by the Hon’ble Supreme Court on the grounds of Medical Exigencies vide its order dated 01.02.2023, that payments shall be made upon submission of documents, as mentioned in detail (Click here for detail). The List of FD Holders who has been found eligible is uploaded on portal.

It may be noted that the list being uploaded now has been cleaned up to take care of multiple/ duplicate entries/ correction of names etc.

For information of FD Holders and Homebuyers who have applied for Refunds on grounds of Medical Exigencies in terms of Hon’ble Supreme Court Orders dated 27.04.2022, 18.05.2022 and 17.08.2022

  1. The Lists of FD Holders who have applied for refunds on the grounds of Medical Exigencies have been uploaded on the portal and virtual hearings in those cases will continue up to 20.09.2022.
  2. The lists of Homebuyers who have applied for refunds on grounds of Medical Exigencies has been uploaded on the portal today i.e. 16.09.2022, along with the schedule of virtual hearings by Justice (Rtd.) A.M. Sapre in respect of cases mentioned in List-A.

Accordingly, the concerned Homebuyers are requested to make it convenient to attend the Virtual hearings as per the dates and time slots given in the List. The Links for the virtual hearing will be sent to them through SMS and Whatsapp on their registered phone numbers the previous day.
